HeroDevs End of Life Dataset Terms of Service and Data Policy
IMPORTANT: THIS IS A LEGAL AGREEMENT. BY DOWNLOADING, INSTALLING, COPYING, SAVING ON YOUR COMPUTER, OR OTHERWISE USING THE HERODEVS’ END OF LIFE DATASET (AS DEFINED BELOW), YOU ARE CONSENTING TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU SHOULD NOT USE THE SOFTWARE.
THESE TERMS ONLY APPLY TO THE USE OF THE EOL DATASET AND NOT TO ANY OTHER HERODEVS PRODUCTS.
1. Introduction
The “HeroDevs End of Life Dataset” (referred to herein as the “EOL Dataset”) is a collection of software used to scan and identify End-of-Life (“EOL”) software that you are using.
These Terms of Service and Data Policy (the “Terms”) explain how HeroDevs collects and uses data when you use the EOL Dataset. By using the EOL Dataset, you agree to these terms.
The CLI, included as part of the EOL Dataset (as found at https://github.com/herodevs/cli) is provided pursuant to the MIT License, all other elements of the EOL Dataset are provided pursuant to these Terms and are owned exclusively by HeroDevs, Inc., unless otherwise stated.
2. Data Collection and Retention
2.1 Package URL (PURL) Data Collection
In order to use the use the EOL Dataset, you will request and confirm the following information be provided to HeroDevs:
- The list of applicable PURLs to be scanned; and
- The time and date that the scan was requested
Based upon the information above, a random identification number will be assigned to the CLI installation submitted. For the avoidance of doubt, the identification number is not tied to an individual person, machine and/or IP address. For clarity, for each scan request a new identification number will be created.
2.2 How We Use This Data
HeroDevs’ collects and retains the PURL data you submit to operate, maintain, and improve the EOL Dataset. HeroDevs may use this data for various business purposes, which may include but are not limited to product improvement, trend analysis, and service enhancement.
You retain ownership of all data and information submitted, however, by using the EOL Dataset You grant HeroDevs permission to store, process, and use this data for our business purposes.
3. Service Usage
3.1 Acceptable Use & Usage Limits
To ensure the EOL Dataset works well for everyone, HeroDevs has reasonable usage limits. HeroDevs reserves the right to temporarily limit any user access / usage if there is an issue which results in overwhelming of services or limiting of other user experience(s).
4. Service Disclaimers
4.1 The EOL Dataset and all information, materials, feedback, and/or other derivatives of the EOL Dataset are provided "AS IS" without any warranty of any kind.
4.2 EOL Information Accuracy
HeroDevs provides no warranty and/or guarantee that any information provided by the EOL Dataset is correct or up-to-date.
5. Updates to These Terms
HeroDevs may update these Terms from time to time. If you continue to use the EOL Dataset, after the Terms have been updated, then You agree to the updated Terms.

7. Limitation of Liability
To the extent permitted by applicable law, HeroDevs and its affiliates will not be liable for any indirect, consequential, special, incidental, or punitive damages related to your use of the EOL Dataset. In no event will HeroDevs’ total liability exceed $100 USD.
